The orphan works bill will make it more likely for art thieves to get away with their thing. Currently it is not on the table but it is expected to surface again.

If Congress is willing to pass THIS law, then they might as well say all kinds of theivery are allowed. As an artist (and a future professional artist), this pisses me off.

Taking away the creations of all artists just to make money is stupid and is the same thing as robbing a bank. I'll favorite this to support vetoing this soon-to-be bill )<

Thank you for contacting me to express your opposition to H.R. 5889, the Orphan Works Act. It is good to hear from you.



Representative Howard Berman introduced H.R. 5889 on April 24, 2008. This legislation would provide a limitation on judicial remedies in copyright infringement cases involving orphan works. An orphan work is a copyrighted work whose owners may be impossible to identify and locate. H.R. 5889 would provide a safe harbor if the infringer proves that they performed a reasonably diligent search to locate the copyright owner before using the work, a Notice of Use filed with the Register of Copyrights, and the infringing use of the work provided attribution to the author and owner of the copyright.



H.R. 5889 has been referred to the House Judiciary Committee for further review. Please be assured, should this legislation be brought to the House floor for a vote, I will keep your views in mind.

Microsoft wants to buy Yahoo - who incidently owns Flikr.com -

and they (microsoft) are already working with Picscout
([link]) and they, MS, hired Jule Sigall who was the man that wrote the ORPHAN WORKS REPORT while he worked for the COPYRIGHT OFFICE.

Then Google has problems with MS, because MS has issues with how Google deals with copyright issues...or maybe because of competition over ads (Google is way out front) - part of the reason everyone is fighting over the images in my opinion...we all search the net, they throw the ads in on the side and that's how they make their money - not to mention what they'll make off registration and searches as well. "Companies that create no content of their own, and make money solely on the backs of other people's content, are raking in billions through advertising revenue and IPOs. Google takes the position that everything may be freely copied unless the copyright owner notifies Google and tells it to stop. " That sounds familar....[link] & ([link] )

Google is hooked up with Getty and AOL (Shawn Bentley went from the US gov. to work for time warner - owner of AOL - as VP of IP and Global Public Policy after he worked in the senate and "helped write are among the most important laws in the intellectual property world: the Satellite Home Viewer Improvement Act; the Digital Millennium Copyright Act, the American Inventors Protection Act, the Patent Fee Integrity and Innovation Protection Act, the Anti-Counterfeiting Consumer Protection Act, and the Trademark Dilution Act, just to name a few.” [link]

Also, any of us that upload any amount of art onto free sites better be taking a really good look at their policies and finding out what they are up to, because Google is obviously interested in the possession of these - and as noted 'WITH NO IDENTIFYING INFORMATION'. ([link])

I added this to my favorites only to propagate the message. Art thievery is a disgrace we should not tolerate.

I am not a painter or photographer, but I do know how it feels to have your work taken from you, sold for profits and denied as being your own, despite everything you've done to create that piece of art. This bill should NEVER be passed. If you cannot find the author of a work of art, then DON'T SELL that work of art. Period.

It would be nice if everyone added this to their favorites to make people more aware of what is going on. After all, seeing it as the favorite of the day would indeed draw attention.

You had me terrified and I made a huge fool of myself telling everyone to worry about this and it isn't even on the table anymore. The bill died, and as far as I know, will stay that way. The articles you link to were written to give their authors more fame. Please take down your stamp and admit you were fooled like I was, or provide some information with dates and less absurdly incendiary language. :(
